Smart Landscaping: Store Policy

Warranty for Products (Purchased with installation included):

SMART Landscaping (“SELLER”) and the Approved Installer (“INSTALLER”) jointly warrants to the homeowner (“BUYER”) that the products (“PRODUCTS”) supplied to BUYER per SELLERS’s invoice furnished to BUYER shall be free from manufacturing defects for a period of Thirty (30) days from the date of installation. SELLER shall have no obligation under this warranty if BUYER subjects materials to improper conditions. SELLER’s responsibility and obligation under this Warranty shall become effective only upon payment in-full for the PRODUCTS furnished by SELLER and installation provided by INSTALLER for this project.

BUYER, INSTALLER and SELLER agree that BUYER’s sole and exclusive remedy under this warranty shall be replacement of the defective PRODUCTS without charge to Owner, F.O.B. jobsite, ANY CLAIMS UNDER THIS WARRANTY SHALL BE MADE IN WRITING ADDRESSED TO SELLER AND INSTALLER WITHIN THIRTY (30) DAYS FROM THE DATE OF THE ALLEGED FAILURE, INCLUDING INFORMATION AS TO THE SPECIFIC LOCATION AND NATURE OF THE CLAIMED FAILURE. A REPRESENTATIVE OF SELLER AND INSTALLER SHALL BE GIVEN REASONABLE OPPORTUNITY TO INSPECT THE ALLEGED FAILURE. SELLER AND INSTALLER EXPRESSLY DISCLAIM ANY AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR OTHERWISE with respect thereto, including, but not limited to, any inaccuracy or ambiguity, or any results to be obtained therefrom.

IN NO EVENT, SHALL SELLER OR INSTALLER BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OR OTHER DAMAGES OF ANY KIND, WITH RESPECT TO THE USE OF THE PRODUCTS, OR IN ANY WAY RELATED TO THIS AGREEMENT, REGARDLESS OF THE FORM OF ACTION (BE IT FOR BREACH OF CONTRACT, WARRANTY, NEGLIGENCE, STRICT LIABILITY, TORT, OR OTHERWISE), INCLUDING, BUT NOT LIMITED TO LOSS OF PROFITS OR LOSS OF USE.

It is further agreed and understood that the price stated for the Products and Installation is consideration for the limitation of SELLERS’s and Installer's liability hereunder. The sales personnel of SELLER are not authorized to make warranties or representations, whether oral or written, about the Products described in this contract. THE ENTIRE CONTRACT IS EMBODIED IN THIS WRITING AND NO OTHER WARRANTIES ARE GIVEN BEYOND THOSE SET FORTH IN THIS WRITTEN CONTRACT. This writing constitutes the final expression of the parties’ agreement, and it is a complete and exclusive statement of the terms of that agreement and supercedes all prior agreements, warranties, or statements regarding the project. This Warranty cannot be amended, altered or modified in any way except in writing signed by an Officer of SELLER or a person to whom his authority has been delegated in writing.

Returns for Products (Purchased with installation included): NO RETURNS ARE ACCEPTED

Exchanges for Products (Purchased with installation included): NO EXCHANGES ARE ACCEPTED

Order Cancellations for Products (Purchased with installation included): To cancel orders within 24 hours, send 1. Send the following information to mpalmer@smartlandscaping.org to receive an Order Cancellation:

Warranty for Products (Shipped Direct):

This warranty is equal to the same period of time provided by the manufacturer’s warranty, EXCLUDING FORCE MAJEURE OR NORMAL WEAR AND TEAR OR ABUSE. THIS EXCLUSION INCLUDES, BUT IS NOT LIMITED TO DAMAGE TO ANY PERSON, ANIMAL OR STRUCTURE. EXCEPT FOR THIS EXPRESS WARRANTY, THE ITEMS PURCHASED ON THIS WEBSITE ARE WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. The sole remedy under this warranty is for a credit or replacement of the product.

Merchandise purchased from SMART Landscaping is covered by the warranty set forth by the manufacturer of the product. SMART Landscaping will cover only product purchases made through SMARTLandscaping.

The steps for warranty claims are as follows:

1. Send the following information to mpalmer@smartlandscaping.org to receive a Return Authorization:

2. Once Return Authorization is received, product is to be shipped at the customer's expense to the following address:

The following information must be included within the package returned:

Date of Purchase

3. Replacements/fixed-goods will be shipped to customer at SMART Landscaping’s expense.

SMART Landscaping has the right to accept or deny warranty claims and is not responsible for any shipping charges for product not covered by warranty or not purchased from SMART Landscaping.

Limitation of Liability

NEITHER SMART Landscaping NOR OUR SUPPLIERS SHALL BE LIABLE FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES INCURRED BY THE BUYER OR ANY THIRD PARTIES AS A RESULT OF ANY ALLEGED DEFECTS OF ANY PRODUCT OR SERVICE PROVIDED HEREUNDER, OR OTHERWISE ARISING FROM THE SALE OR USE OF ANY SUCH PRODUCT OR SERVICE.

Returns for Products (Shipped Direct):

If for any other reason you need to return an item you may do so within 30 days of the date the product was received. Before product is returned, please obtain a Returns Authorization Number so we know what needs to be done with the returned package. Product returned must be in new condition. Returns are subject to a 15% restocking fee. Customer will be credited the price of item(s) at purchase minus any discounts on the order. Customer is responsible for shipment and charges to get product back to our Costa Mesa, CA location. Clearance items, special order items, and cut wire/pipe are not returnable.

The steps for returns are as follows:

2. Once a Return Authorization is received, ship returns to:

3. Credit will be applied to original Credit Card and a confirmation email will be sent to the customer.
